The petitioner apprehends his arrest in a case registered for the offence under Section 304(B)/34 of the Indian Penal Code.
It is a case of dowry death.
It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case only because he is husband of deceased. As a matter of fact, deceased has committed suicide by hanging herself.
However, learned A.P.P. for the State as well as learned counsel for the informant vehemently opposes the prayer for bail and submitted that petitioner is husband of the deceased and there is specific allegation of demand of dowry
Patna High Court CR. MISC. No.27105 of 2022(3) dt.24-11-2022 2/2 against him and his family members. The deceased died within seven years of marriage at her matrimonial house in an unnatural circumstances.
Considering the nature and gravity of the offence and the fact that petitioner is husband of the deceased and there is specific allegation of demand of dowry and torture against him, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay/- U T
