The petitioner apprehends his arrest in Alouli P.S. case No.90/ 2016 under Section 467, 468, 471, 420, 120B, 34 of the Indian Penal Code.
The allegation against the petitioner is that he got appointment on the post of teacher by submitting fake certificate. It is submitted that petitioner passed examination from Gurukul Vidya Mandir Sr. Secondary School, Ranchi and the same was affiliated to Board of Secondary Education, New Delhi and Council of Secondary Education, New Delhi but after enquiry it was found that the aforesaid institution is not at all affiliated. The petitioner has not committed any fraud rather the school which got the admission of the petitioner did not disclose about
Patna High Court Cr.Misc. No.39144 of 2016 (3) dt.29-09-2016 2/2 non affiliation of their institution. The appointing authority should have looked into the matter at the time of appointment. Similarly situated accused, namely, Seema Kumari has already been granted anticipatory bail vide order passed in Cr. Misc. No. 36234 of 2016.
Considering the facts aforesaid and the fact that case of the petitioner stands on same footing as that of Seema Kumari, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in Alouli P.S. Case No. 90 of 2016 (GR No. 782/2016), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
