JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners pray for anticipatory bail in connection with Chanpatiya P.S. Case No. 117 of 2016 registered for the offences punishable under Sections 341, 342, 447, 323, 324 and 307/34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that there is a case and counter case from both sides. It has further been submitted that allegation against the petitioner no.1 is that he has assaulted with spear causing injury to the husband of the informant, which is simple in nature and petitioner no. 2 has assaulted by lathi causing injury, but no specific injury has been caused by the same.

Learned A.P.P. as well as learned counsel for the informant opposes the prayer of bail application.

Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.45483 of 2016 (2) dt.15-12-2016 2/2 bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Bettiah, West Champaran in connection with Chanpatiya P.S. Case No. 117 of 2016, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.
