Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 307, 120B/34 of the Indian Penal Code.
The prosecution case is that six persons namely Chanchal Kumar, Ranjeet Singh, Vikram Kumar, Sonu Kumar, Guddu @ Prashant Kumar and Abhishekh Kumar while travelling on two motorcycles made indiscriminate firing, causing injury to the brother of the informant and sister-inlaw. Subsequently, the sister-in-law of the informant succumbed to the injury. The motive for the occurrence alleged to be nephew of the informant marrying a co-villager Bharti Kumari. Though the victim in 164 Cr.P.C. statement stated that she married with the nephew of the informant of
Patna High Court Cr.Misc. No.56514 of 2015 (2) dt.14-12-2015 her own. The petitioner and others gave life threatening to the informant's side at earlier point of time.
It is submitted by the learned counsel for the petitioner that though in the First Information Report the petitioner and others have been named, but it is specifically alleged in the First Information Report that only six persons travelling on motorcycle. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Runni Saidpur P.S. Case No. 501 of 2014, pending in the court of learned Chief Judicial Magistrate, Sitamarhi.
With the above observation this application is disposed of.
