The petitioner apprehends his arrest in Harpur P.S. Case No. 31 of 2017 registered under Sections 302, 201 and 34 of the Indian Penal Code.

The informant alleged that he got information that the dead body of his brother is kept near the temple of the village. The informant suspected that since love affairs of his brother was going on with Muskan Kumari. Bambam Mandal, the father, brother and other family members of Muskan Kumari might have killed his brother.

The learned counsel for the petitioner submits that there is absolutely no evidence in the entire case diary. No body has seen the occurrence. Brahmdeo Mandal and Raju Mandal, the father and brother of Bambam Mandal, have already been granted anticipatory bail by the order passed in Cr. Misc. No. 45695 of 2017, Soni Devi has already been granted regular bail vide order passed in Cr. Misc. No. 38501 of 2017 and Bambam Mandal, the father of Muskan Kumari, has also been granted anticipatory bail vide order passed in Cr. Misc. No. 47051 of 2017. The case of the

Patna High Court Cr.Misc. No.48009 of 2017 (5) dt.21-11-2017 2/2 petitioner stands on same footing.

Considering the facts, aforesaid, and the nature of allegation made against the petitioner, he, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Harpur P.S. Case No. 31 of 2017 to the satisfaction of Chief Judicial Magistrate, Munger, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
