The petitioners apprehend their arrest in a case registered for offences punishable under Sections 147, 148, 149, 188, 341, 323, 325, 307, 332, 333, 353, 427, 338, 379 and 120(B) of the Indian Penal Code.

As per the allegation due to some unavoidable reason, in view of the apprehension that ballot boxes would be affected by the seepage of the water, the counting of the votes was postponed which infuriated the people and to control them even the police had to resort firing. Petitioner has been named along with 32 named and 500-600 unknown persons as a member of

Patna High Court Cr.Misc. No.37957 of 2016 (2) dt.23-09-2016 2 / 2 mob. It is further submitted that several other similarly situated persons have already been granted bail and the petitioner's antecedent is clean.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Barsoi P.S. Case No. 86 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
