JUSTICE SUDHIR SINGH ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 272, 273 and 290/34 of the Indian Penal Code and Sections 47, 51 and 52 of the Excise Act. Allegation is that from possession of petitioner 142 litres of country made liquor and 4 litres of spirit was recovered. It is submitted on behalf of petitioner that he has falsely been implicated in the present case. No allegation of tampering of witnesses is alleged against petitioner. It is alleged that 142 litres of country made liquor and 4 litres of spirit is said to have been recovered from possession of petitioner. There is no compliance of Section 100 of the Code of Criminal Procedure. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail

Patna High Court Cr.Misc. No.45204 of 2016 (2) dt.15-12-2016 2/2 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned 4th Addl. Chief Judicial Magistrate, East Champaran, in connection with Madhuban P.S. Case no. 112 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
