The petitioner apprehends his arrest in a case registered for the offence under Section 394 of the Indian Penal Code.

As per F.I.R., four miscreants surrounded the informant and on the point of pistol, snatched the mobile phone of informant, out of whom, three miscreants were caught by the villagers and one miscreant fled away, who is said to be petitioner.

It is submitted on behalf of petitioner that name of the petitioner transpired on the basis of confessional statement of other co-accused persons, who were apprehended on spot. No incriminating article has been recovered from the possession of this petitioner.

Patna High Court CR. MISC. No.27405 of 2022(2) dt.14-11-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VIth, Rosera (Samastipur) in connection with Bithan P.S. Case No. 158 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
