JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date: 23-11-2017 Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel for the petitioner submits that the petitioner was promoted to the post of Senior Accounts Clerk in the year 1973 and whereafter promoted to the post of Accountant in the year 1980 and ultimately he retired form the post of Senior Accountant.

The claim of the petitioner is that 5th pay Commission Report was enforced through the Finance Department's Resolution No.660 dated 08.12.1999, whereby the benefit of 5th pay Commission was extended to the employees of the State of Bihar,

Patna High Court CWJC No.19769 of 2012 dt.23-11-2017 2/2 but the fixation of pay of the petitioner, in pursuance of that notification, has not been done though several times he approached to the authority, but they turned their deaf ear and did not give any consideration.

Let the petitioner file a detailed representation before the competent authority, giving details in what manner the illegality has been committed in fixation of pay of the petitioner. If such representation is filed, the competent authority will consider the same and take decision in accordance with law within a period of four weeks form the date of filing of representation by the petitioner. With the aforesaid observations and directions, this writ application is disposed of.
