The petitioner apprehends his arrest in Hayaghat P.S. Case No. 45/2016, registered for the offences punishable under Section 308 and other sections of the Indian Penal Code. The informant alleged that the petitioner, his wife and others assaulted the informant and her husband. Learned counsel for the petitioner submits that some altercation took place due to putting of cow-dung on a vacant piece of land and there was scuffle between the two sides. Petitioner is neighbour of the informant. Simple injury is caused to the person of the injured.

Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner above-named, in the

Patna High Court Cr.Misc. No.46638 of 2016 (2) dt.05-12-2016 2/2 event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Hayaghat P.S. Case No. 45/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
