The petitioner apprehends his arrest in connection with Bahadurpur P.S. Case No. 423 of 2018 (G.O). Case No. 852 of 2018) registered under Sections 272, 273, 420, 467, 120(B) of the I.P.C. and sections 30(a), 32(2), 33, 36, 41(1) of the Bihar Prohibition and Excise Act.
Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to malafide intention of the informant. Petitioner is owner of the alleged vehicle. He did not know about the illegal work. Further submission is that petitioner has got no criminal antecedent.
Learned A.P.P. appearing on behalf of the State
Patna High Court CR. MISC. No.26046 of 2019(3) dt.10-07-2019 2/2 opposed the prayer of the petitioner by contending that on perusal of Seizure List, it appears that huge quantity of I.M.F.L. has been recovered from the possession of this petitioner. Hence, this is not a fit case for anticipatory bail. Having considered the facts and circumstances of the case, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, prayer of the petitioner is rejected.
