JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-09-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the state.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Kotwali (Adampur) P.S. Case No. 662 of 2016 for the offences punishable under sections 420, 467, 409, 468, 471 and 120 B of the I.P.C. Allegedly, the petitioners were appointed as contract teacher but during course of enquiry certificates of the petitioners have been found forged and fabricated.

Submissions is of false implication and that in this case similarly situated other co-accused, namely, Monalisha

Patna High Court Cr.Misc. No.43939 of 2017 (2) dt.19-09-2017 2/2 Kumari, Prakash Chandra Saurya and Rakesh Kumar have been allowed pre-arrest bail vide Cr. Misc. No. 10341 of 2017 and further Sanjay Kumar, Mukesh Kumar, Paramhans Kumar Rajak, Bibhishan Sharma, Pappu Kumar and Mamta Bharti have been allowed pre-arrest bail vide Cr. Misc. No. 14095 of 2017 by another co-ordinate Bench of this Court and as such the petitioners deserve sympathetic consideration.

The learned A.P.P. fairly submits that other coaccused have been allowed pre-arrest bail. In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M, Bhagalpur in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
