The petitioner apprehends his arrest in Parbatta (Bharatkhand) P.S. Case No. 26/2015, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code and Sections 25(1-B)a and 27 of the Arms Act. Manoj Pandit alleged that some altercation took place for tying the cow. Niranjan Pandit thereafter came and entered into the house of Chandana Devi. Niranjan Pandit fired, but Chandana Devi saved herself. Niranjan Pandit assaulted Chandana Devi with kunda.
Learned counsel for the petitioner submits that there is counter version being Parbatta (Bharatkhand) P.S. Case no. 25/2015 and the present case is filed to save the skin. No arms and
Patna High Court Cr.Misc. No.39791 of 2016 (4) dt.28-10-2016 2/2 ammunitions were recovered from the possession of the petitioner, the same was produced by the informant himself, but it appears from perusal of the case diary that the petitioner opened firing and Chandana Devi got providential escape. The empty cartridge and the snatched pistol were handed over to the police. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
