Sri Chandrasen Prasad Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 17-10-2017 Heard Sri Raj Narayan Mishra, learned counsel for the petitioners and Sri Chandrasen Prasad Singh, learned Additional Public Prosecutor.
Four petitioners, apprehending their arrest in Chandi P.S. Case No. 39 of 2017 registered for the offence under Section 30 of the Bihar Prohibition & Excise (Amendment) Act, 2016 have prayed for grant of bail in the event of their arrest or surrender.
It was submitted by learned counsel for the petitioners that 35 liter of country made liquor was recovered from a field which was not of petitioners and petitioners' name has come
Patna High Court Cr.Misc. No.38591 of 2017(4) dt.17-10-2017 2/2 on the basis of statement of the local chawkidar who said that petitioners were involved in the crime. Learned counsel for the petitioners has also drawn my attention to the statement made in paragraph no. 3 of the petition to show that petitioners are having clean antecedent.
Considering the nature of accusation and clean antecedent of the petitioners, in the event of their arrest or surrender within a period of six weeks from today, let the aforesaid four petitioners Ram Bihari Singh @ Bauaa @ Ram Vihari Singh @ Babuwa , Jilal Singh, Vijendra @ Bijendra Singh and Mintu @ Pintu @ Mintu Singh @ Pintu Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J. 4th, Bhojpur at Ara/ concerned court in connection with Chandi P.S. Case No. 39 of 2017 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure , 1973 .
