Learned counsel for the petitioner is directed to remove the defect(s) as pointed out by the office within a period of four weeks.

The petitioner is apprehending his arrest in a case registered under Sections-7 of the Essential Commodities Act. Prosecution case in short is that 95 quintals of rice has been have been recovered from shop of the petitioner. It is submitted on behalf of the petitioner that there is no allegation of tampering of witnesses is alleged against the petitioner. 95 quintals of rice is said to have been recovered from shop of the petitioner. So far rice is concerned, the same does not come within the purview of Control Orders. The

Patna High Court CR. MISC. No.27634 of 2022(2) dt.14-11-2022 2/2 present case has been instituted case due to mistake of fact. No offence under Section-7 of Essential Commodities Act is attracted in the present case.

Learned counsel for the State submits that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances, let the petitioner named above, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 673 of 2019 subject to the conditions as laid down under Section-438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) A.K.V.//- U T
