2. State counsel accept notice for respondents. Petitioner's counsel to serve copy of the petition to the State counsel, if it is not already served.

3. In the instant petition, petitioner has prayed for following reliefs:- "That this is the writ petition being filed before this Hon'ble High Court on behalf of the aforesaid petitioners for issuance of a writ in the nature of "mandamus" commanding and directing the state respondents to accept the resignation letter dated 11.04.2021 which has been tendered by him to the respondent No. 4 on the ground of his serious ailments

Patna High Court CWJC No.11733 of 2021 dt.07-03-2022 2/2 such as slipdesk, heart disease and serious Neuro problem which have disabled him to discharge his official duty in sound health and mind. Further prayer of the petitioner is to command and direct the state respondent to make the payment of all the retiral benefits as earliest as possible after the acceptance of resignation letter."

4. Petitioner's grievance relating to acceptance of resignation letter dated 11.04.2021 is pending consideration before the competent authority-respondent.

5. The competent authority is hereby directed to examine whether petitioner can submit his resignation for his acceptance or not. If there are any hurdles, in that event necessary speaking order shall be passed and communicated to the petitioner as to why petitioner's resignation letter dated 11.04.2021 cannot be accepted. If petitioner has made out a case for its acceptance, the same shall be accepted in accordance with law. The above exercise shall be completed within a period of one month from the date of receipt of this order.

6. With the above observations, the present petition stands disposed of.
