JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 533 of 2018, disclosing offences under Sections 323, 341, 379, 452, 354(B), 498(A) and 504/34 of the Indian Penal Code.
Petitioner happens to be husband of the complainant and allegation against the petitioner is of subjecting the complainant to cruelty and torture with respect to non fulfilment of demand of dowry and also ousted from the house. It appears that on appearance of opposite party no. 2, the matter was referred to Patna High Court Mediation and Conciliation Center, Patna and the report of learned Mediator is available on record, from which, it appears that in the
Patna High Court CR. MISC. No.26004 of 2019(5) dt.11-09-2019 2/3 mediation, the petitioner was ready to keep the complainant -wife with full honour and dignity dispute bu the complainant was not ready to live with the petitioner rather she expressed her desire for one time settlement and thus the mediation between the parties failed.
Learned counsel for the petitioner has submitted that he is ready to keep the complainant with full honour and dignity. Heard learned A.P.P. also as well as learned counsel for the complainant. Learned counsel for the complainant has submitted that due to cruelty meted out to the complainant, she is not ready to live with the petitioner rather she wants one time settlement.
In such view of the matter, this application is disposed of with direction to the petitioner to surrender in the court below within a period of six weeks from the date of receipt of this order, on which, the court below shall release him on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of like amount each to satisfaction of learned Judicial Magistrate -1st Class, Madhubani, in connection with Complaint Case No. 533 of 2018 subject to the condition as laid down under Section 438(2) Cr.P.C.
