JUSTICE SUDHIR SINGH ORAL ORDER 19-06-2019 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner is languishing in custody since 22.01.2019 in a case for the offence registered under Section 304 of the IPC.

The prosecution story, in brief, is that one cattle thief named as Kabul was killed by the mob and brutally assaulted by aggressive crowd.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the

Patna High Court CR. MISC. No.27906 of 2019(4) dt.19-06-2019 2/2 present case. There is no substantive evidence to suggest the implication of the petitioner in the present case. Other coaccused have been granted bail by this Bench as well as by another Co-ordinate Bench of this Court vide Cr. Misc. No. 23603 of 2019 order dated 16.04.2019, Cr. Misc. No. 29106 of 2019 order dated 09.05.2019 and Cr. Misc. No. 31643 of 2019 order dated 13.05.2019.

On behalf of the learned counsels for the State and the informant, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Araria, in connection with Sikty P.S. Case No. 240 of 2018 (G.R. Case No. 4109 of 2018).
