The petitioner apprehends his arrest in connection with Imamganj P.S. case no. 98 of 2017 for the offence under Section 7 of the Essential Commodities Act.
Counsel for the petitioner submits that this Court has granted anticipatory bail to similarly circumstanced accused, namely, Suresh Singh, in Cr. Misc. No. 39841 of 2017, who is accused in another case, and the case of petitioner is identical to that of accused Suresh Singh, the petitioner deserves similar treatment.
In view of the fact that the case of the petitioner is identical to the case of Suresh Singh, who has been granted anticipatory bail vide Cr. Misc. No. 39841 of 2017, this
Patna High Court Cr.Misc. No.41069 of 2017 (3) dt.17-10-2017 2/2 application is allowed on the same terms and conditions like the petitioner of Cr. Misc. No. 39841 of 2017, as the allegation against the petitioner of this case is identical to that of Suresh Singh, who is accused in Imamganj P.S. case no. 97 of 2017, the petitioner, named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the amount each to the satisfaction of SubDivisional Judicial Magistrate, Sherghati, Gaya in connection with Imamganj P.S. case no. 98 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
