17-10-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner, in the present, case, is seeking Anticipatory Bail in connection with Rupaspur P.S. Case No. 76 of 2017 for the offences under Sections 304(B)/316/34 pending in the court of Additional Chief Judicial Magistrate, Danapur.

Learned counsel for the petitioner submits that in fact it is a case of false implication of the petitioner who happens to be the husband of the deceased.

On the other hand, learned Additional Public Prosecutor opposes the prayer for bail and submits that it is a marriage of the year 2013 and the death has taken place in

Patna High Court Cr.Misc. No.44301 of 2017 (3) dt.17-10-2017 suspicious circumstance, for which, the petitioner, who is the husband, is unable to explain.

Considering the facts and circumstances particularly that the petitioner is husband and there is an allegation of causing death because of non-fulfillment of dowry, I am not inclined to enlarge the petitioner on anticipatory bail.

Accordingly, prayer for anticipatory bail of the petitioner is rejected.
