The petitioner apprehends his arrest in connection with Purnahiya P.S. Case No. 26 of 2013 for the offences punishable under Sections 384 and 386 of Indian Penal Code. Mr. Virendra Kumar learned counsel for the petitioner with reference to the F.I.R. submits that the allegation is directed against one Raja Ram who is the owner of the sim card bearing No. 9708204506 from where the alleged extortion call was made. He submits that neither the mobile number belongs to the petitioner nor he is named in the F.I.R. rather it is on the basis of confessional statement of co-accused that his name has transpired. Having heard learned counsel for the parties and considering the circumstances existing, let the petitioner namely, Ashok Kumar Yadav in the event of their arrest/surrender within four weeks from today, be released on bail upon furnishing bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Sheohar in connection with Purnahiya P.S. Case No. 26 of 2013 subject to the conditions stipulated under Section 438(2) of the Code of Criminal Procedure.
