The petitioner apprehends his arrest in connection with Jehanabad P.S. Case no. 320 of 2016, registered under Sections 420, 467, 468 and 471 of the Indian Penal Code.
The accusation is that the land was acquired for construction of National Highway. Rajnandan Yadav and Mithilesh Prasad filed petitions along with Land Possession Certificate and get the compensation on the basis of Land Possession Certificate. Later on, family members of Rajnandan Yadav and Mithilesh Prasad filed petition that they are also entitled for compensation as the land which is acquired is joint family property.
Learned counsel for the petitioner submits that petitioner is an Amin in the office of the Land Acquisition Office and as such he has no concerned in issuing the land possession certificate. Further
Patna High Court Cr.Misc. No.43768 of 2016 (2) dt.19-10-2016 2/2 submission is that, in fact, Land Possession Certificate is issued on behalf of the Halka Karmchari by the Circle Officer. Further submission is that the Head Clerk of Land Acquisition Office, Jehanabad has already been enlarged Anticipatory Bail vide Criminal Miscellaneous No.35110 of 2016, dated 20.09.2016. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 320 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
