ANJANA MISHRA ORAL ORDER 05-01-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Belaganj P.S. Case No.62 of 2015 for allegedly having committed the offence under Sections 255, 406, 409, 467, 468, 471, 475 and 476 of the Indian Penal Code. Mr. Kanhaiya Prasad Singh, learned Senior Counsel appearing on behalf of the petitioner submits that the petitioner is a registered stamp vendor, who had inadvertently not signed on the stamp sold by him. The amount involved is merely of Rs.50/-. The allegation is that subsequently the petitioner signed on the stamp paper on which certain documents were executed and as such, the allegation is that having signed later
Patna High Court Cr.Misc. No.57447 of 2015 (2) dt.05-01-2016 2/2 on, he has committed an act of forgery. It is further submitted by the learned counsel for the petitioner that such signing of document at a later stage on the stamp is not deemed to be an act of forgery as he has merely complied with his own duty by endorsing the same on the stamp sold, which merely indicates that he had filled up the lacuna.
Considering the nature of allegations made and also the fact that the petitioner is a man of clean antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Belaganj P.S. Case No.62 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
