2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3 . As per the prosecution case , 6596.640 liters illicit liquor was recovered from seized seized truck .
4. It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case only on the basis of confessional statement of other co-accused persons. Petitioner is neither owner nor driver of the seized vehicle . No incriminating material has been recovered from the conscious possession of petitioner and he is no way connected with the
Patna High Court CR. MISC. No.26361 of 2025(2) dt.23-04-2025 2/2 alleged occurrence . Petitioner claims clean antecedent. 5 . Learned APP for the State vehemently opposed the bail application .

Considering the fact that petitioner is neither owner nor driver of seized vehicle , clean antecedent and other circumstances of the case , this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned special Judge Excise II Kaimur at Bhabhua in connection with Durgawati P. S. Case No. 50 of 2024 , subject to condition as laid down under Section 482 ( 2 ) of BNSS 2023 .
