JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 384, 387, 504, 506, 134 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged that, on the alleged date and time of occurrence, while the complainant was constructing bouncary wall on the purchased land, this petitioner along with other accused persons demanded ransom of Rs. 5 lakhs and also threatened that if the ransom amount is not paid, construction could not proceed.
It is submitted that due to pre-existing land dispute between the parties this petitioner has been made accused in this
Patna High Court CR. MISC. No.27554 of 2023(2) dt.11-07-2023 2/2 case in order to harass him. Petitioner is aged about 70 years. Petitioner has filed title suit bearing Title Suit No. 319 of 2018 in the court of Munsif-I, Gaya with respect to the same land. Learned counsel for the State opposes the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Gaya in connection with Complaint Case No.516 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Alok Verma/- U T
