The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 364, 302, 201, 506/34 of the Indian Penal Code.
Informant suspects that this petitioner alongwith other FIR named accused persons committed murder of the informant's son and threw the dead body in Kabristan. Earlier also, these accused persons were involved in kidnapping of the victim, for which, another case had been lodged. Learned counsel for the petitioner submits that only on suspicion, petitioner has been implicated in this case. Informant is not eye witness of the occurrence. Petitioner was not named in the earlier case lodged for kidnapping of the victim. No other tangible evidence has been collected during course of investigation to suggest the implication of this
Patna High Court CR. MISC. No.27196 of 2022(3) dt.24-11-2022 2/2 petitioner in the present case. Similarly situated co-accused persons have been granted bail by this Court, vide order dated 20.10.2022 passed in Cr.Misc. No. 33193 of 2022. Petitioner has got no criminal antecedent.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S.
