Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366, 366A of the Indian Penal Code.

The prosecution case is of abducting the minor daughter of the informant.

It is submitted by the learned counsel for the petitioner that though in 164 Cr.P.C. statement the victim has named the petitioner as the person who abducted her, but has not alleged any physical misbehaviour. Moreover, the informant has retracted from the initial version and filed a petition to that effect before learned court below, hence, it is a case for simple elopement.

Patna High Court Cr.Misc. No.55800 of 2015 (2) dt.09-12-2015 The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Aurangabad (Town) P.S. Case No. 300 of 2015, pending in the court of learned Chief Judicial Magistrate, Aurangabad. With this observation this application is disposed of.
