ANJANA MISHRA ORAL ORDER 05-04-2018 Heard learned Senior Counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends her arrest in connection with Jakkanpur P.S. Case No. 64/2018 registered for the offences punishable under Sections 25(1-B)(a)(b)/30/35 of the `Arms Act. Learned Senior Counsel for the petitioner submits that the entire allegation is false and farfetched and she has role to play, save and except, the fact that the vehicle in question belongs to her and that the arms which were recovered therefrom, were duly licensed arms registered in her name. It is submitted that the petitioner is a political figure and she has been under threat and, therefore, such licences were issued in her name and she carries them to and fro from her place of residence to her office located in Mithapur.
In view of the aforementioned facts and circumstances and that there being no cogent material to connect the petitioner with the alleged incident of kidnapping, let the petitioner in the event of
Patna High Court Cr.Misc. No.16782 of 2018 (2) dt.05-04-2018 2/2 her arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned A.C.J.M.- cum- Sub Judge, 1st, Patna, in connection with Jakkanpur P.S. Case No. 64/2018, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
