JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 409, 420, 467, 468 and 471 of the Indian Penal Code.

The prosecution case is that when Patahi go-down of State Food Corporation was inspected when huge quantity of shortage of wheat and rice was found when Assistant go-down manager Bishwanath Paswan was made accused. Earlier also with similar accusation, Patahi P.S. Case No. 101 of 2015 was lodged wherein the stock was verified and the stock was found in order when co-accused Bishwanath Paswan was granted bail. The name of the petitioner sprang up during investigation. It is submitted by learned counsel for the petitioner that the petitioner is neither the employee of State Food Corporation

Patna High Court Cr.Misc. No.56320 of 2015 (2) dt.11-12-2015 2/2 nor he is PDS dealer nor named in the FIR. Co-accused Bishwanath Paswan has been granted bail vide Cr. Misc. No. 53158 of 2015. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 8th East Champaran at Motihari in connection with Patahi P.S. Case No. 125 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
