Petitioners apprehend their arrest in connection with a case registered under Sections 448, 341, 323, 379, 384, 504, 506, 34 of the Indian Penal Code.
Allegation in brief is that when the petitioner was getting his wooden log transported all accused persons turned up and asked unless extortion money is not paid; they would not allow to take away the wooden log.
Learned counsel for the petitioners submits that in fact there is dispute between both sides and from the petitioners' side a proceeding under Section 107 of the Code of Criminal Procedure was initiated against the informant and both sides are co-villagers and other co-accused persons have been granted anticipatory bail
Patna High Court Cr.Misc. No.39053 of 2017 (2) dt.19-08-2017 2/2 by a Co-ordinate Bench of this Court and the case of the petitioners stands on similar footing and they have also got no criminal antecedent.
Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners, namely, Md. Chhotka and Md. Lola be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Teghra P.S. Case No.266 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
