JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-10-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Goraul P.S. Case No. 279 of 2019 registered for the offence under Sections 25(1-b)A, 26/35 of the Arms Act.

On secret information, a raid was conducted and coaccused Gautam Kumar was arrested and from whose possession, a country-made loaded pistol and a mobile phone were recovered, who disclosed the name of petitioner, as one of the accused, who fled away.

It is submitted on behalf of petitioner that petitioner is innocent and has been falsely implicated by the co-accused due to his enmity with petitioner's family. Petitioner is student of B.A. in BBAB University, Muzaffarpur. As per statement made

Patna High Court CR. MISC. No.24515 of 2020(2) dt.01-10-2020 2/2 in paragraph - 3 of the petition, the petitioner has no criminal antecedent.

Considering the nature of allegation and clean antecedent of the petitioner, the anticipatory bail application is allowed. In the event of arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - 1st, Vaishali at Hajipur, in connection with Goraul P.S. Case No. 279 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J.) anay/- U T
