07-10-2020 Heard learned counsel for the petitioners and learned A.P.P. for the State through video conferencing. The petitioners apprehend their arrest in Mahua P.S. Case No. 138 of 2020 registered for the offence under Sections 304(B)/34 of the Indian Penal Code.

As per the prosecution case, on 03-05-2019, the daughter of the informant was married with co-accused Arbind Ram. It is further alleged that after the marriage, all the accused persons, including petitioners, started demand of dowry and due to non-fulfillment of the same, they started torturing daughter of

It is further alleged that on 13-03-2020, the informant got an information that his daughter is seriously ill and as such, when he reached at the matrimonial home of his daughter, he saw that the accused persons were carrying the dead body of his daughter for cremation.

It is submitted on behalf of petitioners that petitioner no. 1 step mother-in-law of deceased (lkSrsyh lkl), petitioner no. 2 is grand-father of husband of deceased (ukuk) and petitioner nos. 3 & 4 are maternal uncle of husband of deceased (ekek). It is further submitted that there is no specific allegation against petitioners. Petitioners are living separately. There is general and omnibus allegation. Specific allegation of demand of dowry is against co-accused Arbind Ram (husband of deceased). Considering the aforesaid facts and circumstances, the bail application of petitioners is allowed. In the event of their arrest or surrender within a period of eight weeks from the date receipt/production of copy of this order, let the above-named petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 138 of 2020, subject to condition as laid down under
