09-09-2020 Heard learned counsel for the parties through video conferencing.

This relates to grant of regular bail in Jandaha P.S. Case No. 01 of 2020 registered for the offence under Sections 304(B)/34 of the Indian Penal Code.

As per F.I.R., the daughter of the informant was married with petitioner in the year 2017, but due to nonfulfillment of demand of Rs. 5 lacs, as dowry, she was subjected to cruelty and harassment and it is alleged that on 04-01-2020, the informant received information that his daughter has been killed by her in-laws members.

It is submitted on behalf of petitioner that petitioner, who is husband of deceased, has committed no offence and he has falsely been implicated in this case. In fact, the deceased has

Patna High Court CR. MISC. No.23202 of 2020(2) dt.09-09-2020 2/2 committed suicide due to mental illness. The petitioner has got clean antecedent and he is in custody since 06-01-2020. However, considering the aforesaid fact and perusing the material available on record, it is evident that deceased was subjected to torture by her in-laws members, including petitioner, for demand of Rs. Five lacs and death has occurred within seven years of marriage, I am not inclined to grant bail to the petitioner.
