The petitioner seeks bail in Karja P.S. Case No. 83 of 2021, registered for the offence under Sections 337, 338, 279, 414, 307/34 of the I.P.C., Section 30(a) of Bihar Prohibition and Excise Act and Section 4 / 40 of Bihar Mining Act. Total 387 liters & 270 ml. of illicit foreign liquor has been recovered from a pick-up van and this petitioner, who was one of the occupant, was arrested on spot.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the said pick-up van and he is in custody since 07.04.2021.

Learned A.P.P. for the State has opposed the bail petition.
