The petitioner apprehends his arrest in connection with Kuchaikote P.S. Case no. 19 of 2015, registered under Sections 420, 406, 323, 379, 384, 504, 341 and 120(B) of the Indian Penal Code. Learned counsel for the petitioner submits that it would appear from the complaint petition itself that Kuchaikote P.S. Case No. 125 of 2013 was instituted on the basis of the written report of Ranjan Kumar Dubey regarding the occurrence in between 2004-05 in which the complainant of present case was a witness in the said case. The petitioner was allowed Anticipatory Bail on 20.01.2014 passed in Criminal Miscellaneous No. 2890 of 2014, thereafter the complainant, who was witness in the said case, filed this present case with similar allegation only to harass the petitioner and others. Having regard to the facts and circumstances of the case,
Patna High Court Cr.Misc. No.43770 of 2016 (2) dt.19-10-2016 2/2 let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-III, Gopalganj in connection with Kuchaikote P.S. Case No. 19 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
