In this case, the petitioners are apprehending their arrest in connection with Dharahara P.S. Case No. 53 of 2017 registered for offences under sections 147, 148, 149, 341, 323, 324, 307, 504, 448 and 506 of the Indian Penal Code. In the First Information Report, an allegation has been made that in the morning while the Informant was at his Darwaja, the accused persons, namely, Bhairo Yadav, Maintu Yadav, Bablu Yadav, Bambam Yadav and Jeevan Yadav came to his house, thereafter, on the order of Bablu Yadav, Bambam Yadav and Jivan Yadav assaulted the brother of the Informant,

Patna High Court Cr.Misc. No.41092 of 2017 (2) dt.04-10-2017 Vikash Yadav.

The dispute has arisen on account of the fact that a small boy had gone for natural call in the field of the accused persons. The petitioner no.1 is the spectator whereas petitioner no.2 is the order giver.

Looking to the entire facts and circumstances of the case, let the petitioners, namely, Bhairo Yadav and Kablu Yadav @ Kably Yadav, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Munger in connection with Dharahara P.S. Case No. 53 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Shivaji Pandey, J) Rishi/- U T
