The petitioner apprehends his arrest in Hasanpur P.S. case No. 100/2017 registered under Section 380 of the IPC. The informant alleged that on 10.07.2017 burglary in his house was committed and many valuable articles including three mobiles were stolen away. The case was lodged against unknown but during the course of investigation the petitioner was found using the stolen mobile after inserting his SIM. The learned counsel for the petitioner submits that petitioner purchased the mobile from a repair shop but it appears that petitioner was using the stolen mobile and process u/s 82 and 83 of Cr. P. C. has already been exhausted. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
