====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 03-12-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Bela P. S. Case No.144 of 2019, instituted for the offences under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 15.04.2021 and charge-sheet has been submitted in this case.

Allegation is of recovery of 288 litres of Nepali Saufi wine from a jute bag of the accused persons.

The learned counsel for the petitioner submits that the petitioner was not apprehended at the place of occurrence rather his name was disclosed by the accused, who were apprehended

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 15.04.2021, charge-sheet has been submitted in this case, the petitioner and his name was disclosed by the accused, who were apprehended at the spot, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Bela P. S. Case No.144 of 2019.

The application stands allowed.
