The petitioner has preferred this application for grant of regular bail in a case registered under sections 420, 467, 468, 272 and 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on a raid being conducted it is stated that 3833.28 litres of liquor was recovered and one of the labourers being caught at the place of occurrence, he disclosed that the liquor belonged to the three named accused persons including the petitioner herein.

It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any incriminating article has been recovered from his possession. He

Patna High Court CR. MISC. No.36878 of 2021(2) dt.06-01-2022 2/2 has been falsely implicated in the case because of his antecedents. The petitioner is in custody since 20.3.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not having been caught at the place of occurrence and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Sakra P.S. Case no. 556 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
