JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 09-03-2022 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Katra P.S.Case No. 250 of 2020 for the offences punishable under Sections 341, 323, 307, 379, 504/34 of the Indian Penal Code .

Learned counsel for the petitioner submits that petitioner no. 1 namely, Ram Umed Thakur and petitioner no. 3 Ravi Thakur@ Mithu, have been arrested and as such, application of petitioner nos. 1 and 3 become infructuous.

Patna High Court CR. MISC. No.36540 of 2021(2) dt.09-03-2022 2/3 Accordingly, bail prayer of the petitioner nos. 1 and 3 is dismissed as withdrawn.

As per allegation in the F.I.R, all the accused persons came at the house of the informant and assaulted him by lathi danda and iron rod, and he sustained injury on his head.

Learned counsel for the petitioner submits that there is case and counter case between the parties and both the parties have sustained injuries. No specific allegation is against the petitioners. Petitioners have got no criminal antecedent.

Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioners in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Muzaffarpur in connection with Katra P.S Case No. 250 of
