JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2017 Heard learned counsel for the petitioners as well as the A.P.P. for the State.

This application is for grant of anticipatory bail for the offence under Sections 366 (A)/34 of the Indian Penal Code. It has been submitted on behalf of the petitioners that though name of the petitioners transpires in the FIR but no specific allegation has been alleged against these petitioners and even during the investigation, nothing has transpired against these petitioners.

Heard learned A.P.P., who opposes the prayer for bail

Patna High Court Cr.Misc. No.48598 of 2016 (3) dt.10-01-2017 stating that there is allegation of kidnapping of minor girl, who is still traceless.

Considering the aforesaid facts and circumstances of the case, I am not inclined to grant bail to the petitioners, however, the petitioners may surrender and move for regular bail before the court below, which will be considered on merit especially on submission of the petitioners as nothing has come during the course of investigation.

With the above observation, this application is disposed of.
