The petitioner apprehends his arrest in Agiaon (Garhani) P.S. case No. 06 of 2017 for the offences punishable under Section 379/411 of the Indian Penal Code. The informant caught Anil Yadav while committing theft of paddy. The informant also disclosed the name of Pintu Yadav and petitioner, who managed to flee away from the place of occurrence.

The learned counsel for the petitioner submits that petitioner had dispute with the informant with regard to payment of wages and that is why he has falsely been implicated in the case but it appears that informant saw the petitioner while fleeing away from the place of occurrence and Anil Yadav was apprehended on

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

If the petitioner surrenders in the court below, i.e., the learned Additional Chief Judicial Magistrate, VII, Bhojpur at Ara in Agiaon (Garhani) P.S. case No. 06 of 2017, the learned court below shall consider the prayer for regular bail of the petitioner taking into consideration that Anil Yadav and Pintu Yadav have already been granted bail and the case of petitioner stands on the same footing.
