The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 307, 394, 302/34 of the Indian Penal Code and Sections 25(1-b)a/26/27 and 35 of the Arms Act.

The prosecution case is that three unknown criminals shot at one Sanjay Prasad, who later on succumbed to his injuries.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Neither the petitioner is named in the FIR not put on TIP. There is no eye witness of the alleged occurrence. The name of petitioner and co-accused Raja Kumar came into light on the basis of

Patna High Court CR. MISC. No.27022 of 2022(3) dt.06-04-2023 2/2 confessional statement of co-accused Saroj Kumar. Similarly situated co-accused Raja Kumar has already been granted bail by this Court vide order dated 29.06.2022 passed in Cr. Misc. No. 67498 of 2021. Petitioner is languishing in judicial custody since 10.6.2021.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Pupri, Sitamarhi in connection with Pupri P.S. Case No. 56 of 2021.
