JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-06-2023 Though the present writ petition has been filed for quashing the order dated 24.04.2012 passed by the Collector-cum-District Magistrate, Purnea, whereby and whereunder the earlier order passed by him granting the benefits of first A.C.P. to the petitioner with effect from 09.08.1999 and the benefits of second A.C.P. with effect from 07.05.2003, has been cancelled, however, it is the contention of the learned counsel appearing for the respondent-State that the said error has been now rectified/amended vide order dated 04.09.2013 and it has been directed to grant first A.C.P. and second A.C.P. to the petitioner with effect from 09.08.1999 and 07.05.2003 respectively as well as the benefits

Patna High Court CWJC No.22729 of 2013(2) dt.22-06-2023 2/2 of third M.A.C.P. with effect from 07.05.2009. Nonetheless, it is the contention of the Ld.

Counsel for the petitioner that till the year 2015, the petitioner had not received the benefits, as aforesaid.

The learned counsel for the respondentState submits that in case the benefits emanating out of the aforesaid order dated 04.09.2013 have not been paid to the petitioner, the same would definitely be paid within a period of four weeks from today.

It is directed accordingly.

It is needless to state that in case the benefits have not already stood paid, the same shall be paid to the petitioner within a period of four weeks from today, failing which the District Magistrate, Purnea shall not draw his salary. The writ petition stands disposed off on the aforesaid terms.
