The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 364(A) of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that the father of the informant was recovered by the police after his abduction and three persons were arrested. It is next submitted that the statement of the victim was recorded under Section 164 CrPC in which he has not named the petitioner.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner but fairly submits that from
Patna High Court CR. MISC. No.26919 of 2022(6) dt.28-06-2023 2/2 perusal of the statement of the victim recorded under Section 164 CrPC at Para 40 of the case diary, it manifests that the victim has not taken the name of the petitioner. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Phulwari Sharif P.S. Case No. 575 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
