This is an application for grant of anticipatory bail in connection with Jalley P.S. Case No. 130 of 2015 registered for the offence punishable under Sections 420, 409, 467, 468 and 471/34 of the Indian Penal Code.

The allegation is regarding the Assistant, Indra Aawas Yojna and ward member of Ward No. 9, Gram Panchayat Raj, Deora, Bandhauly having committed irregularities in the amount disbursed for the Indra Aawas Yojna and having taken bribe from the beneficiaries of the said amount.

The learned counsel for the petitioner submits that the petitioner is non F.I.R. named accused person and his name has

In any view of the matter, it is submitted that similarly situated co-accused person has already been granted anticipatory bail by an order dated 05.02.2018 passed in Criminal Miscellaneous No. 5131 of 2018. It is further submitted that the petitioner is having a clean antecedent. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Jalley P.S. Case No. 130 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
