Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
This application for anticipatory bail arises out of Bihiya P.S. Case No. 426 of 2020 for the offence punishable under Sections 147, 149, 431, 323, 307, 325, 379, 504 and 506 of the Indian Penal Code.
Learned counsel for the petitioners seeks permission to withdraw this bail application on behalf of petitioner no.3, above named, who has been arrested by the Police.
Accordingly, this bail application is dismissed as
Patna High Court CR. MISC. No.36557 of 2021(2) dt.07-04-2022 2/2 withdrawn as against petitioner no.3, above named. The petitioner nos. 1 and 2 are said to have assaulted the prosecution side for dispute over road. They are said to have caused injury.
Considering the nature of injury sustained by the injured and also the fact that the occurrence has taken place on a trivial issue, this bail application on behalf of petitioner nos. 1 and 2, above named, is allowed.
Accordingly, let the petitioner nos. 1 and 2, above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Bihiya P.S. Case No. 426 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sandeep Kumar, J) pawan/- U T
