The petitioner had prayed for a direction to the Commissioner, Begusarai Municipal Corporation for initiating action against the respondent no.3 who according to the petitioner was indulged in illegal construction. A counter affidavit has been filed by the Commissioner himself and Dr. Amitesh Kumar, learned counsel appearing for the Corporation with reference to the statement made in Paragraphs- 10 and 11 of the counter affidavit has submitted that the matter was heard by the Commissioner in the backdrop of the enquiry report submitted and after giving opportunity to the respondent no.3. It is stated that since the matter has been heard
Patna High Court CWJC No.24332 of 2013 (5) dt.10-05-2016 2/2 even final orders would be passed in the matter by the Commissioner on the complaint of the petitioner. Having heard learned counsel for the parties and considering the stage at which the matter rests before the Commissioner, I find no reason to keep the writ petition pending which is accordingly disposed of.
