This application for anticipatory bail arises out of Complaint Case No. 3465 of 2010, disclosing offences under Sections 420, 406 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act.

Despite service of notice on Opposite party No.2, there is no representation on his behalf.

In view of the submission made on behalf of the petitioner that the parties have resolved their disputes and there is no representation to counter such submission, this application is allowed.

Let the above named petitioner in the event of his

Patna High Court Cr.Misc. No.47533 of 2017(4) dt.07-03-2018 2/2 arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in Complaint Case No. 3465 CA of 2010, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court below on two consecutive occasions, his bail bonds shall be liable to be cancelled.
