The petitioner seeks bail in Muffasil P.S. Case No. 56 of 2019, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that in course of search, total 49 pouch of illicit liquor of 200 ml each has been recovered from conscious possession of petitioner. Learned counsel for the petitioner has submitted that petitioner is in custody since 16.03.2019.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.24426 of 2019(2) dt.16-04-2019 2/2 satisfaction of the learned Addl. Sessions Judge VII-cum-Special Judge, Excise Act, Aurangabad, in connection with Muffasil P.S. Case No. 56 of 2019. Both the bailors will be close relative of petitioner.
From paragraph 3 of bail petition, it appears that other case of Excise Act are also pending against him. The petitioner will file affidavit at the time of release that he would not indulge himself in such type of activities in future. If he is found indulged in such type of activities, his bail bond in the instant case will liable to be cancelled. (Sanjay Priya, J) khushbu/- U T
